This web site known as hepatitiscnews.com (the “Site”) is operated by Tudor Reilly Ltd, company registration number 06262589 with registered office at PO Box 1295, 20, Station Road, Gerrards Cross, Buckinghamshire SL9 8EL and VAT registration number 920 8106 52 (“we”, “us” or “our”).

Please read the information below carefully.  Any person browsing, accessing or otherwise using the Site (“you”, “your” or “yours”) is treated as having accepted these Terms and Conditions of Use, together with our policies on Privacy and Data Protection for users of the Site.  If you do not agree with the Terms and Conditions, then please do not browse, access or use the Site.

1. Registered Users policy

1.1 Our Site is intended for adults based only in countries in which participation in our Site is not illegal, unlawful or otherwise restricted. Please do not register if you are under 18 years of age and/or are accessing our Site from any country in which participation in our Site is illegal, unlawful or otherwise restricted.

1.2 You warrant that you are over 18 years of age and that all of the personal details you provide to us on registration are true and accurate and will be kept up to date by you.

(iii) you comply with these terms and conditions.

If, for any reason, we believe that you have not complied with these requirements, we may, at our discretion, cancel your access to the registration areas of our Site immediately and without giving you any advance notice.

2. Postings supplied by you

2.2 You hereby represent and warrant that all of your Postings comply with these terms and conditions. You will indemnify us for breach of that warranty.

(i) where they state facts, be accurate;
(ii) where they state opinions, be genuinely held;
(iii) comply with applicable law in the UK and in any country from which they are posted.

(i) are your own work (or that you have all necessary rights in and to all Postings you provide and all material they contain);

(ii) do not infringe any proprietary or other rights of third parties;

(iv) do not contain any viruses or other contaminating or destructive devices or features;

(v) do not contain any defamatory, indecent, offensive, tortuous, or otherwise unlawful or immoral material or content;

(vi) are not used to carry out or solicit any unlawful activity and/or be used to make commercial solicitations;

(vii) do not promote sexually explicit material;

(viii) do not promote violence;

(ix) do not promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;

(x) are not threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety;

(xi) are not likely to harass, upset, embarrass, alarm or annoy any other person;

(xii) are not used to impersonate any person, or to misrepresent your identity or affiliation with any person; and

(xiii) do not advocate, promote or assist any unlawful act.

2.5 Your Postings must not include any personal details (including any image of any other person) about anyone other than yourself (and you should be cautious about revealing your own personal details on our Site).

2.6 You hereby authorize us to copy and use and/or authorize others to use all or part of your Postings in any manner, format, or medium that we or such other parties see fit throughout the world. You hereby waive all moral rights in relation to any Postings.

3. Monitoring and moderating

3.1 Publication of any Posting shall be at our sole discretion.

3.2 Please be aware that we have no obligation to (and do not always) exercise editorial control over Postings or other information that users post to the Site and such information does not necessarily reflect our views.

3.3 Notwithstanding Section 3.2, we reserve the right to monitor all Postings and to remove all or part of any which we consider in our absolute discretion to be offensive or otherwise in breach of these terms and conditions.

3.4 We would like our Site to be accurate, informative and incorporate quality content.  Notwithstanding the above, we may moderate all Postings and make alterations at any time and at our discretion.

4.2 Your complaint will be dealt with by our team in accordance with our internal moderation and take down policy and guidelines in place from time to time.  A member of our team will use reasonable endeavors to respond to you although you should be aware that we receive, review, investigate and deal with complaints only during our normal business hours.

4.3 We reserve the right to terminate your registration if we suspect any misuse of our complaints procedure.

5. Liabilities and disclaimer

THIS IS AN IMPORTANT CLAUSE. ITS EFFECT IS TO LIMIT AND EXCLUDE OUR LIABILITY UNDER THESE TERMS. YOU SHOULD READ IT CAREFULLY AND MAKE SURE YOU ARE HAPPY WITH IT BEFORE AGREEING TO THESE TERMS.

5.1 Nothing in these terms shall limit our liability for fraud or for death or personal injury caused by our negligence or in relation to any other liability which cannot be excluded or limited by law.

5.5 Subject to Sections 5.1, 5.2, 5.3 and 5.4, our total aggregate liability arising from any claim relating to the use or operation or content of our Site shall not exceed an amount equal to the total amounts paid or payable by you for your participation in the Site (if any), such amount to be calculated at the time when our liability comes to be assessed, or to £500.00 (whichever shall be the greater).
